Overview

The postponement of Nigeria’s fifth election since its return to civilian rule in 1999, together with fierce political competition, a security crisis and severe economic challenges linked to the drop in oil price, have thrown into sharp relief the challenges of conducting this essential process in such a complex environment. While there is widespread speculation as to the reasons for the delay, there is also widespread acknowledgment of the necessity that national elections do now take place as scheduled on 28 March.
General Muhammadu Buhari, former military ruler (1983-85) and now opposition presidential candidate, will discuss the importance of democracy for Africa’s future, and in particular why delivering dividends of elected government matter both to Nigeria and internationally.

Governor Fayose Confesses To Partaking In Ekiti Poll Rigging Meeting Secretly Recorded By Army Captain Koli



Ekiti state governor, Ayodele Fayose has finally confessed to partaking in the secret meeting where politicians led by former minister of state for defense, Musiliu Obanikoro met with army officer led by a Brigadier General plotted how to rig last August's gubernatorial election for Mr. Fayose.
Mr. Fayose was speaking  at an event in Ekiti where he inadvertently referred to the tape and then he quickly tried to change his story by claiming that he was only chastising the army general for being compromised in the presense of his collegaues. Mr. Fayose's confession contrasts his earlier stance that the tape was manufactured with the aid of a voice software.  The minister of Police Affairs, Jelili Adesiyan had earlier confessed to being at the meeting, however, President Goodluck Jonathan told reporters from the Wallstreet Journal during a recent interview that the tape was not "real" stating that the incident will not be probed.

The Constitutional Obligation of The Armed Forces to Safeguard Elections.

Yesterday, the INEC Chairman indicated that the elections will not hold as scheduled on the 14th and 28th of February 2014.  The ostensive reason provided was the inability of the military and security agencies to guarantee security for the elections.  In other words the armed forces and the security agencies are unable to fulfill their constitutional obligations of Section 217(1)(c) to the nation. The military and security apparatus have decided that obeying provisions of the constitution to provide a secure environ for these elections is something they consider non-feasible! ' 'Jega was quoted to have told the council that the commission was ready for the conduct of the election but the military chiefs were quoted to have said they could not guarantee the security of electoral officers, materials and the electorate should the commission go ahead with the earlier schedule.'  In the plain meaning of actions   or words, they appear to imply they will not receive operational directions from civilian led authorities in form of INEC contrary to Section 217(1)(c).  I suggest a dangerous precedent has been set here, one in which we may not recover from if not arrested.

So what are the options?  

  • In a situation where the men in uniform are no longer able to guarantee security for a lawful process as General Elections as specified in the provisions below, then the question arises why they continue to adorn the uniform of the Armed Forces of the Federation of Nigeria?  They should relinquish their command, not hide behind a 4-year insurgency and allow others more capable and aware of the constitutional responsibilities to assume command.


  • It is an act of cowardice for a Commander-in-Chief who is operationally responsible for the Armed Forces as detailed below to outsource it to the National Security Adviser. The President himself should have addressed this issue himself, in fact the nation, if he felt the military were unable to perform their constitutional mandate and then fired them with cause.  The principle of civilian led and directed military must be held sacrosanct and in this case it has been breached because of a deification of duty. 


  • The National Assembly should be convened immediately to address and forestall any further constitutional breaches and investigate the role of the NSA and military chiefs in orchestrating what appears to be a subversion of military authority.


  • Finally, it, the NSA and security forces' actions should be challenged in a court of competent jurisdiction.


I conclude by stating we are in a dangerous phrase here and we must forestall any attempt by this government and others to remain in office beyond the 29th May by any other means than through the ballot box... 

Here are the relevant provisions of the Constitution...

217. (1) There shall be an armed forces for the Federation which shall consist of an army, a navy, an Air Force and such other branches of the armed forces of the Federation as may be established by an Act of the National Assembly.

(2) The Federation shall, subject to an Act of the National Assembly made in that behalf, equip and maintain the armed forces as may be considered adequate and effective for the purpose of -

(a) defending Nigeria from external aggression;

(b) maintaining its territorial integrity and securing its borders from violation on land, sea, or air;

(c) suppressing insurrection and acting in aid of civil authorities to restore order when called upon to do so by the President, but subject to such conditions as may be prescribed by an Act of the National Assembly; and

(d) performance such other functions as may be prescribed by an Act of the National Assembly……….

218. (1) The powers of the President as the Commissioner-in-Chief of the Armed Forces of the Federation shall include power to determine the operational use of the armed forces of the Federation.

(2) The powers conferred on the President by subsection (1) of this section shall include power to appoint the Chief of Defence staff, the Chief of Army Staff, the Chief of Naval Staff, the Chief of Air Staff and heads of any other branches of the armed forces of the Federation as may be established by an Act of the National Assembly.

(3) The President may, by directions in writing and subject to such conditions as he think fit, delegate to any member of the armed forces of the Federation his powers relating to the operational use of the Armed Forces of the Federation.

A New York-based security firm that helped analyse the voices of the characters in the shocking leaked recording on the rigged Ekiti election has given insight into how it determined the authenticity of the audio clip.

In a report, Guardian Consulting said it conducted a forensic examination on the discussion and compared the voices to public record samples of the known individuals.
In an interview with PREMIUM TIMES, Tom Fitzgerald, the President of the company, confirmed that his company did the investigation.
“I can confirm that we did the testing,” Mr. Fitzgerald said.
He declined further comments, referring PREMIUM TIMES to a London-based firm, ATP Advisers, who he said gave his company the job.
ATP Advisers could not be reached for comments.
According to his Linkedin profile, Mr. Fitzgerald was a former detective with the New York Police Detective [NYPD] and the Foreign Bureau of Investigation (FBI). He has over 30 years’ experience as a detective of repute.

Guardian Consulting Group LLC were engaged on Nov. 10 to conduct forensic examinations on an audio recording purported to be a private discussion among presumed Nigerian officials regarding disrupting an election (“The Recording”). The first phase of the engagement was to conduct analysis to identify the voices on The Recording by comparing them to public record samples of known individuals. The second phase was to judge the veracity of selected parts of the conversation to a degree of scientific survey.
Executive Summary of Findings:
IDENTIFICATION
The following voices from The Recording were subjected to a Forensic Voice Frequency Comparison against known samples and were found to match to a 98% degree of certainty:
• Governor Avo Favose
• Senator Iviola Omisore
• Hon. Abdulkareem
• Caleb Olubolade
The following voice from The Recording was subjected to a Forensic Voice Frequency Comparison against a known sample and was found to match to an 80% degree of certainty:
• Senator Musiliu Obanikoro
VERACITY
• Gov. Avo Favose was being truthful when he said:
…there is no vehicle that left this place without that sticker.
• A person identified as Obanikoro with 80% of certainty was judged to be completely truthful when he said to a person identified as Abdul Kareem: If am a happy man tomorrow night, the sky is your limit, and at the end of the day if am unhappy…I am not here for tea party, am on a special assignment by the president.”
• A person identified as Abdulkareem with a 98% degree of certainty said: “I was the one who created road blocks, I was the officer on ground sir.”)

METHODOLOGY
Starting with provided sample, identified here as The Recording, voices were isolated and five voices were positively identified as uniquely identical through voice print analysis. One additional background voice fragment was isolated but no identification was made (N.B. It is possible that the additional voice came one of the five subjects but was distorted due to a recording or transmission glitch). The unidentified voice fragment was fleeting and did not make up a substantial part of the conversation.
The Forensic Voice System (“FVS”) measures including frequencies discernable by the human ear as well as others above and below human recognition. Patterns of the frequencies are entered into the FVS in which a Frequency Voice Print is then produced and displayed. The Voice Print is quantified for comparison.
The process was repeated with the provided known samples and Voice Prints were established for each of the five subjects.
Identical words were identified from The Recording and the known samples. Each of the identical words was printed. The prints were then compared leading to the following conclusion:
• Governor Ayo Fayose was found to match the public sample to a 98% or greater degree of scientific certainty.
• Senator Iyiola Omisore was found to match the public sample to a 98% or greater degree of scientific certainty.
• Honourable Abdulkareem was found to match the public sample to a 98% or greater degree of scientific certainty.
• Caleb Olubolade was found to match the public sample to a 98% or greater degree of scientific certainty. Sen. Musiliu Obanikoro was found to match the public sample to a 80% or greater degree of scientific certainty.
The prints were further analyzed for veracity. No substantive untruths were identified: 85% of the conversations were deemed to contain identifiable veracity to a 98% degree of certainty. The remaining 15% was identified as inconclusive. The findings are based on the samples supplied. We relied on public identification of the known samples.
Further analysis of the voice attributed to Sen. Musiliu Obanikoro may result in a higher degree of certainty, but quality of the original recording not the additional publicly available samples are the primary reason for this level of veracity being listed. Further analysis against the new samples will be completed on Monday December 1.

We came in just now and we saw so many check points none of them stopped us. We had to be stopping and asking why they are not stopping us, and while we are doing that, a lot of vehicles….. We had military men in our convoy and police in our convoy, and yet we expected to stop and demand to know who is inside.

Sitting down with this man would mess this election up for you. (koro cuts in “no no no”).
Koro: Who dis-arm who? Why were they dis-armed?
Caleb Olubolade: listen koro, I was asking you one question one time. (Senator Omisore cuts in “they have collected money. The police now that are working, they are dis-arming them too.”) I asked one question from you, why was our police men dis-armed, you now answer are they working with us? Where we are supposing to be collating, the thing INEC gave to us, soft copies we now printed and everything, because they see INEC thing on top of it, why is my contact man not with them, i said my contact man would be sitting in the check point permanently. i convince this man to leave this people, they were said to sit in the sun. they packed all the computers, its took me more than 2 hours to get this man to release this people. we have been subjected to serious embarrassment, (Caleb Olubolade cuts in ” then what we have been told is that the army have been compromised”) they have been compromise.
They are now dis-arming police too that want to work, in my local government, my own local government the same thing. today, they were sharing money in the government house, i called them, people in the government house who loves us were taking pictures how they were putting money in envelopes, i called them, did everything, instead its our own rebel that is arrested co-incidentally, it’s the money i wanted to go and give to him.

The war is eminent. i was in my house, “chief of
army staff” call me, and told me he has briefed him, and gave me his number because i never met him before. He told me, you are in safe hands; he would perform, and if you have any issues, call me. He told me that i have made it clear to him that i am Jonathan for this election. Chief of army staff told me, have never met him before in my life. He only called me with the instruction from the villa. Each time we explain this this to this man, he porous, everything is porous.
Caleb Olubolade: anyway, i don’t want us to….. where we are now general, we held so many meetings, that i don’t belief we should be in this situation now. The idea of having headship, is that everybody should work together. under no circumstances what so ever is for anyone to be dis-armed number one. number 2 is that, (general cuts in: excuse me sir this dis-harming of a thing, is it the thing that led to eemmmh…. am a commander (koro cuts in : wait, the guy just left with the lady, the team that left here as we are being told, are being dis-armed, that’s why we are worried.
Fayose: we even said this stickers must not be shared until its 4 o’clock.( general cuts in: when did we share the stickers? un- identified Hausa man answered: by 16:00hrs”) the guys that just left just called that the soldiers have dis-harmed us, that they were as good as beating us. (koro cuts in ” sit down general, sit down please”) who are you that you say am insulting you, if am in the military, i would be a brigadier or general today. so what are you saying, am a member of the national assembly. (koro cuts in: i don’t like all this embarrassment, we all left our home to come here, we are here for the same thing. i don’t like the way the honourable is talking, i asked him to come here, if you are a member of the national assembly so, i was once a senator too. show some respect.”)

This man, we cannot keep him here indefinitely. let us make progress, give him instructions on what we want him to do, let him go and do it, let us monitor him, and make sure those things are done, cause as he’s seated here, other people are monitoring his movement (person 2 “God bless you sir”) give him instructions. The gubernatorial election in Ekiti State, Nigeria, took place on the 21st June, 2014. The two main contenders were Ayo Fayose and Kayode Fayemi from the PDP and APC respectively. Below is a transcript of a recording of a secret meeting that took place on the night before the election.
Context
All those present are upset by the failings of the military to execute their plan of intimidation and electoral fraud in line with what was agreed/ordered by the President of Federal Republic of Nigeria and Chief of Army Staff of the Federation. All those present are expressing their disapproval of the job done to date to the to the Brg General in charge of the operations.
